Making history in Bermuda

The Bermuda Government wanted to introduce legislation to help guarantee legal ownership of land and simplify the conveyancing process. At the time, property transactions took months to complete and at a high cost.

In 2003, the Bermuda Government invited us to conduct an in-depth review of their project plans to introduce land title registration. As part of this work, we met with key stakeholder groups and presented our findings to land and property market professionals. We then provided our report to the Bermuda Government outlining our recommendations to move forward.

From 2007 until 2011, we continued to provide support and assistance to Bermuda’s Attorney General’s Office in preparing the appropriate legislation to introduce land title registration. Our legal expert produced a policy brief identifying the requirements for introducing the legislation.

As a result, Bermuda Parliament passed through a Bill to introduce the legislation that was enacted as Land Title Registration 2011.

Marc Bean, Bermuda’s Environment Minister at the time said “this Government foresees significant benefits accruing to the public as a result of the implementation of the Land Title Registry. Such a system should provide the guarantee of legal ownership of land and the simplification of conveyance transactions. Once a parcel of land is registered, the register will become the definitive record of title and subsequent transactions can be carried out in a fraction of the time and a fraction of the cost.”
