Sir Anthony Clarke discusses the management of very complex cases involving large amounts of money. He identifies some key features of case management as the identification of the real issues between the parties; meetings of experts to identify areas of common ground and areas of dispute between them; and a trial process that is as focused as possible.
The supercases Bank of Credit and Commerce International (BCCI) and Equitable Life are timely reminders that the Civil Procedure Rules need to be applied to each individual case appropriately, fairly and robustly, he says.
