Mediation: An integral part of our litigation culture

Lord Clarke looked at the relationship between mediation and litigation, describing mediation as an “integral part” of the civil process.

“ADR and mediation are, as I see it, an essential supplement to the role of the court and as such are and must be an integral part of our litigation culture. They seem to me to facilitate access to justice for the many, and hence presuppose an effective formal civil justice system, by ensuring that only those cases that truly need to resort to formal adjudication do so.”
