Human Rights and Civil Wrongs: Tort Law Under the Spotlight

Lady Justice Arden looked at the effect of the European Convention on Human Rights on domestic torts – civil wrongs.

Areas covered in her lecture included: privacy; breach of confidence and intrusive media attention; and liability of public bodies for negligence.

She concluded:

“The Convention has informed developments in some areas of our tort law, but in other areas, not at all. The decision has been that of the judges. This has given enormous discretion to the judges.”
