In the judgment handed down on 23 April this year Mr Justice Foskett indicated (in paragraph 41 of Appendix 2) that he intended to raise with the Treasury Solicitor personally the question of whether he was satisfied "that proper efforts were made to obtain all documents from Ofsted for the purposes of discharging its duty of candour" and he referred to a number of specific matters in that connection.

The Treasury Solicitor wrote to the Judge on 27 April indicating how he intended to respond and the sequence of correspondence between them is attached to this notice.

The parties have seen this exchange of correspondence.

Subject to any representations that might be made, the Judge has asked the parties to let him know by 4 pm on Monday, 28 June, whether there are any consequential applications to be made in the light of his judgment or whether any further extensions of time for doing so are sought. He will consider the position in the light of those responses.
