Constitutional Justice: Lessons from Magna Carta

Speech by Sir Anthony Clarke, Master of the Rolls

16/06/2008

Sir Anthony Clarke considered Magna Carta’s potential future influence in general, and its potential influence on constitutional justice - the exercise of the power in a court to review the legality of legislation.

“Any extension of the powers of the courts should be the result of democratic debate. Magna Carta points the way. Its principles are enshrined in the conscience of the people and anyone, whether executive or judiciary, who disregards those principles does so at his, her or its peril.”
