Meeting the challenge of terrorism: The experience of English and other courts

Speech by Lady Justice Arden

16/08/2006

Lady Justice Arden looked at the legal issues that arise from terrorism in relation to counter-terrorist legislation across the world by examining major developments in the jurisprudence, including examples from:

  • the European Court of Human Rights
  • the United Kingdom
  • the United States
  • South Africa
  • India
  • Canada, and
  • Australia

She also considered how the law must adapt to the new challenges, and how courts, while being the guardians of individual rights, have to also take into account the seriousness of the terrorist threat.

The article then draws some conclusions regarding lessons for the future.
