Description

This Joint protocol between the Crown Prosecution Service and the Association of Chief Police Officers, published on 11 September 2014, sets out the principles governing the investigation and prosecution of stalking offences under sections 2A and 4A of the Protection from Harassment Act 1997 (PHA 1997) and covers all forms of stalking.

Title

Stalking Legislation One Year On – Joint Police/CPS Response

Description

Letter issued by the Director of Public Prosecutions, Alison Saunders CB and Assistant Chief Constable Garry Shewan, the National Policing Lead for Stalking and Harassment. This letter has been issued to mark the first anniversary of the new stalking offences coming into force.

As it makes clear, whilst there have been a number of successful prosecutions for stalking in the past year, we recognise that there is much more for police and prosecutors to do in order to ensure that the stalking offences are being used as fully as they should be. The CPS and the police have jointly committed to addressing a number of key areas through a National Protocol over the coming months which should lead to an increased use of the stalking offences.

Nick Hunt, CPS Director of Strategy and Policy, will be overseeing the National Protocol.

Title

2013 Protocol and good practice model ("2013 Protocol"): Disclosure of information in cases of alleged child abuse and linked criminal and care directions hearings

Description

The 2013 Protocol and Good Practice Model: Disclosure of information in cases of alleged child abuse and linked criminal and care directions hearings (2013 protocol) covers all aspects of information exchange from the Local Authority and the Family Court to the police and CPS and vice versa. The 2013 protocol applies to all cases of alleged child abuse (sexual and non-sexual abuse). The 2013 protocol ensures that disclosure takes place from the outset of the investigation to the maximum extent permitted and required by law.

The President of the Family Division and the Senior Presiding Judge are signatories to the 2013 protocol. The 2013 protocol includes arrangements for the joint management of concurrent criminal and care proceedings by the courts.

The 2013 protocol is effective from 1 January 2014, and CPS Areas should draw up local protocols with Local Authorities, police forces and their local judiciary as soon as possible.

Description

The Bar/CPS Standard for Communication between Victim, Witness and the Prosecuting Advocate, published in February 2006, encourages engagement between the prosecutor and victim groups and witnesses during the court process.
