These terms and conditions ("the Terms and Conditions") apply to your use of the website under the domain name www.ogc.gov.uk ("the Website") and to any other correspondence that you may post to the Website or send via email in response to a request for information on the Website.

Your use of the Website indicates that you agree to be bound by the Terms and Conditions, so please ensure that you read the Terms and Conditions carefully before accessing the Website.  If you do not agree do these Terms and Conditions do not use the Website.  Please also refer to the Privacy Policy.

1. Your use of the Website

1.1 You are only permitted to use the Website in accordance with these terms and conditions and for a lawful and proper purpose.

2.1 OGC provides the information and guidance on the Website for the purposes detailed on the relevant page of the Website.

3.1 OGC will use all reasonable endeavours to ensure that the Website is available to users 24 hours a day, 7 days a week.  However, OGC shall not be liable if for any reason the Website is unavailable for a period of time.

3.2 OGC reserves the right to temporarily suspend the Website in the event of maintenance, repair or for any other reason, where it is considered necessary by OGC.

5.1 The Website may contain links to other websites.  OGC does not approve, endorse or check any third party websites and shall not be responsible for any information, materials, products or services provided on the third party website.  Please also refer to the OGC Hyperlinking policy.

7. Limitation of Liability

7.1 OGC and any other party involved in creating, producing, maintaining or delivering the Website, exclude all liability and responsibility for any loss or damage that may result to you or a third party (including, without limitation, any direct, indirect, punitive or consequential loss or damages, or any loss of income, profits, goodwill, data, contracts, use of money, or loss or damages arising from or connected in any way to business interruption, and whether in tort, contract or otherwise).  OGC also excludes liability for the use or inability to use the Website or any materials on it, or any websites linked to the Website.

7.2 OGC shall not exclude or limit any liability which cannot be excluded or limited under applicable law.

8.1 The Website is provided "as is" without any representation or warranties (either express or implied), conditions or other terms of any kind.  OGC exclude all liability for any loss or damage to the full extent permitted by law.

8.2 OGC will endeavour to ensure the accuracy and completeness of the Website.  It shall not however, be responsible for any errors, omissions or out of date information on the Website.  The information provided by OGC on the Website represents OGC view on the particular issue.  If you are placing reliance upon any information on the Website, you are strongly advised to seek your own legal advice.

8.3 OGC shall not be responsible for any disruption of the Website or loss or corruption of any information whilst in transit or when downloaded onto any computer system.

9. Privacy Policy

9.1 OGC will process all personal data transmitted to the Website in accordance with the Data Protection Act 1998 and in line with OGC’s Privacy Policy.  Please note that the Privacy Policy will not cover any third party websites to which we may provide links.

9.2 The Website is owned by the Office of Government Commerce, HM Treasury, 1 Horseguards Road, London, SW1A 2HQ.  The Office of Government Commerce is registered as a data controller with the Information Commissioner under registration number Z7239824.

10. General

10.1 The Terms and Conditions may be varied by OGC only.

10.2 You may not assign or transfer any rights or obligations under the Terms and Conditions.  OGC may assign or transfer any rights or obligations to any third party.

10.3 Headings are inserted for your convenience and shall not affect the interpretation of the Terms and Conditions.

10.4 If any part of the Terms and Conditions are found to be invalid, unenforceable or illegal, the other provisions shall remain in force.

10.5 The Contracts (Rights of Third Parties) Act 1999 shall not apply to the Terms and Conditions

10.6 Reference to any statute or statutory provisions includes a reference to the statute or statutory provision as from time to time amended, extended or re-enacted.

10.7 The Terms and Conditions are governed by and construed in accordance with English law.
