Terms & conditions
  1. The exhibition and competition are organised by the Board of Trustees of the Tate Gallery (“Tate”).
  2. By submitting your story to the TH.2058 Unilever short story competition (the “Competition”), you represent and warrant to Tate that your submitted story does not contain any offensive or defamatory content, that it is an original work written by you, free from any third party rights, in particular that under no circumstances does it constitute, whether entirely or in parts, any infringement upon the intellectual property rights or any other rights of third parties.
    This shall also apply if the story is used for promotional purposes in connection with the promotion of the competition and Tate's exhibition TH:2058 Unilever Series: Dominique Gonzalez-Foerster ("Exhibition") at Tate Modern as specified in paragraph 3 below.
  3. a) Further, by submitting your story to the Competition, you provide Tate with a limited, non-exclusive, irrevocable, sub-licensable, worldwide, royalty-free licence (but not the obligation), which licence is effective until 13th April 2009, for the duration of the Exhibition and until the end of the judging of the Competition, to use, copy, modify, translate and/or adapt, distribute, publicly perform, publicly display by any means and in any media and create derivative works of, and copy, distribute, publicly perform and publicly display such derivative works of your story solely in connection with the inclusion of your story in activities related to, and the promotion of , the Competition and the Exhibition, without any further notice or remuneration to you. The rights shall be applied to all existing or future media, and in particular all physical, optical, magnetic, analogical, digital and electronic media, including media such as hardcopies, magnetic tapes, floppy disks, CD-ROMs, DVD-ROMs, hard disks, computers and servers, the Internet, all private or public telecommunication networks, by cable, satellite, radio networks, etc.
    b) By submitting your story to the Competition you also give Tate a non-exclusive, worldwide, royalty free, irrevocable licence in perpetuity to display and archive your story on Tate's website, Tate Online ('Website') in relation to the Exhibition. In the event that your story is displayed on Tate's website, it will be displayed with the name you supply.
  4. In the event that your story submitted to the TH.2058 Unilever short story competition is short-listed by Tate as part of the final 10 in the Competition, you give Tate a non-exclusive, worldwide, royalty free, irrevocable licence in perpetuity to use your story for the following purposes:
    • to use, copy, modify, translate and/or adapt, distribute, publicly perform, publicly display by any means and in any media and create derivative works of, and copy, download, distribute, publicly perform and publicly display such derivative works of your story and store your story in Tate's online and offsite archive in relation to the Exhibition;
    • to display your story on Tate's website, Tate Online ("Website"), or in Tate Modern in relation to the Exhibition;
    • to create a free audiobook podcast in relation to the Exhibition, which will be distributed through Tate's Podcasts page and through Tate's iTunes page
    • to create a printed book in relation to the Exhibition ("Book"), which will be sold via Blurb.com;
    Tate shall not be obliged to display stories and shall not be liable for any entrant's loss of publicity or enhancement of reputation.

    Tate reserves the right to cancel the Exhibition and/or Competition if deemed necessary at any stage.
  5. In the event that your story is chosen as part of the final 10 in the Competition, it will be displayed in the Book, on the Website with the name you supply to us. We will contact you via email and you will be given the opportunity to confirm this name to us. If you do not respond to this email, Tate will be obliged to use the name supplied at submission. You will receive a complimentary copy of the Book, and we will contact you via email to arrange delivery of this copy.
  6. Any personal information of entrants will only be used and, where necessary, disclosed to third parties, for the purposes of running the Competition and otherwise in accordance with the Tate Online Privacy Policy.
  7. By submitting your story to the TH.2058 Unilever short story competition you are deemed to have accepted the above Terms and Conditions.
