Family Procedure Rules - a new procedural code for family proceedings [CP 19/06]

This consultation invited comments on the policy behind the new Family Procedure Rules. These rules will comprise a single unified code of practice and procedure along the lines of the existing Civil Procedure Rules. They are intended to modernise the current language, and where possible align the procedures between different levels of court and harmonise the rules for family proceedings with the Civil Procedure Rules.

Consultation paper

The consultation paper proposed four key objectives that the rules intend to achieve:

(1) modernisation of language
(2) harmonisation with the Civil Procedure Rules
(3) a single unified code of practice
(4) alignment in all levels of courts

The paper invited suggestions at to how those objectives could be realised in six specific areas, including matrimonial and civil partnership proceedings, children's proceedings and appeals.


This report summarises the responses received to the consultation. It sets out how the responses have shaped the rule-making process and the conclusions that have been reached on most areas including the terminology for divorce, appeals from family proceedings courts and the procedures for dissolution and divorce.
