This is a report for consultation by the Department of Health and the NHS Department of the Welsh Assembly Government. The purpose is to inform the preparation of new legislation.

The report concerns the law in England and Wales on the removal, retention and use of human organs and tissue from living people and those who have died (including stillborn children and fetuses). The review arose specifically from concerns that human organs and tissue had often been stored and used without consent. This has been a particular issue where organs have been retained after post mortem examination without either an express intention on the part of the dead person or the knowledge or consent of families and relatives.
