Judicial Review Judgment

The High Court judgment in the case of R (on the application of Pamela Duggan) v HM Assistant Deputy Coroner has been handed down.

Mrs Duggan’s claim for judicial review has been dismissed.

Judicial Review Update

14 July 2014

The oral hearing of Mrs Pamela Duggan's Judicial Review took place on 9 and 10 July 2014. Sir Brian Leveson, the Chief Coroner and Burnett J indicated that it was highly unlikely that they would give judgment until October.
 
At the end of the hearing they invited the parties to answer in writing two questions:
1) What does the conclusion of lawful killing mean in law?
2) What is the best way in a case of this kind for the Coroner to obtain from the jury precise and public findings which explain in law and for the public their short-form conclusions?

Report to Prevent Future Deaths Under Schedule 5 to the Coroners and Justice Act 2009

The Coroner has today finalised a Report to Prevent Future Deaths, made under Schedule 5 to the 2009 Act. It expresses a number of concerns which are addressed to various authorities. Those authorities will today be given copies of the report under regulation 28(4)(a) of the Coroner’s (Investigations) Regulations 2013. They have until 24 July 2014 to provide responses to the Coroner.

Further, copies will be delivered to other interested persons who are not the subject of concerns, including the Duggan family, pursuant to regulation 28(4)(c) of those Regulations.

The decision whether to publish the report, or a summary of it, is for the Chief Coroner to take under regulation 28(5)(a). Unless and until he decides in favour of publication, the contents of the report will remain confidential.

Update on Process and Delivery of Coroner's Schedule 5 Report

28 May 2014

The Coroner is currently minded to send a copy of the full report to everybody mentioned in the report whom he believes may have the power to take relevant action. He would send it pursuant to Regulation  28(4)(a) of the Coroners (Investigations) Regulations 2013.

He is also minded to send a copy of the report to the family, as well as to other interested persons whom he does not believe to have power to take relevant action. He would do that under para 28 (4) (c) of the Regulations.

In the case of the family, he presently believes that they would find the report of interest, consistently with the purpose of the Art 2 investigative obligation i.e. for them to have the satisfaction of knowing that lessons learned from Mark Duggan's death may save the lives of others.

Whether the Report is published in full is a matter for the Chief Coroner.

The Coroner has considered all the submissions in relation to his Schedule 5 Report on action to prevent other deaths. 

The Report will be finalised by end of May.

It will be delivered to those who may have power to take action. They have 56 days to respond.

On Monday 14 April 2014, his provisional recommendations were sent to a number of organisations.
 
They have until Monday 5 May to serve any responses.

Schedule 5 Report - Action to Prevent Other Deaths - Coroners and Justice Act 2009

The Assistant Coroner has invited the Interested Persons (IPs) to serve on the Inquest team provisional written submissions on the contents of any Schedule 5 Report by 12 noon on 31 January 2014.

These will be considered by the Assistant Coroner at the start of February.

Thereafter, he will draw up a list of the areas which are thought by the IPs to give rise to a concern covered by Schedule 5 Section 7.

This list will be circulated to all the IPs for service of any further submissions within a reasonable period of time - to be fixed.

The Coroner has expressed his gratitude to the jurors for their careful attention in this difficult and important inquest.

The Coroner will consider the findings and conclusion given by the jury and then turn to his obligation under Schedule 5 of the Coroners and Justice Act 2009. That requires him to make a report about anything revealed in the course of his investigation which gives rise to a concern that circumstances creating a risk of other deaths will occur or continue to exist in the future and, in his opinion, action should be taken.

The Coroner has directed the jury that, pursuant to s.9(2) of the Coroners and Justice Act 2009, they may reach conclusions and findings on which at least 8 of them are agreed.

The Coroner has proposed that if the jury has not reached its conclusions and determinations by the close of business on Thursday 19 December, the Inquest should be adjourned for Christmas, returning on Tuesday 7 January 2014.

Oral Hearing Application by the BBC to Revoke Notice - 13 September 2013

An Oral Hearing will take place at 12 noon in court 73 at the Royal Courts of Justice. The hearing will be open to the public.

The Assistant Coroner will hear an application by the BBC to revoke a notice served on it to:

i. provide evidence to him in the form of a written statement setting out the names and addresses of the persons concerned with making the video footage relating to Mark Duggan's death and aired by the BBC on 26 April 2012; and

ii. produce for his examination a copy of that footage with its audio track.

Instead, the Assistant Deputy Coroner HHJ Cutler will now consider all written submissions and rule thereon.

Service of Documents - 3 June 2013

A number of documents will be ready for service on the legal teams on Monday 3 June 2013. These were recently 'cleared' for Public Interest Immunity purposes and have undergone the usual redaction process on Data Protection Act grounds. Further, as the rulings on anonymity are still provisional, all those who have applied for anonymity have been given a cipher in the documents. 
 
In order to avoid any inadvertent disclosure, and given the short time-scale for the redaction process, these documents are served on the teams on the basis that they are for the lawyers eyes only and not to be shown to their clients for 14 days (i.e. until Monday 17 June). This timescale may be shortened as we approach the hearing date.

A large number of documents originating from the Metropolitan Police Service and the Independent Police Complaints Commission will be ready for service on the legal teams on Monday 13 May 2013. The Inquest team is in receipt of materials from the IPCC and the MPS which may bear on the issues for use at the Inquest.

Anonymity applications

These have been served on behalf of the Commissioner of Police of the Metropolis and a number of individual Metropolitan Police Officers.

An update on these applications will be given at the Pre Inquest Hearing on 25 March 2013, including practical arrangements for any screened witnesses.

Public interest immunity applications

No applications for public interest immunity have been made at this stage.

It is proposed that the Inquest Team will redact the materials for data protection reasons.

The materials will then go back to the original sender to make any applications for public interest immunity, or for further redactions for data protection/anonymity reasons.

If any of the Interested Persons have any objections to this process, they are invited to raise this as an item for the agenda for the Pre Inquest Hearing on 25 March 2013.

Inquest Reform Notice

19 February 2013

A recent change in the law means that coroners will no longer be restricted to holding Inquests within their own district and will be free to choose different locations in England and Wales.

The change to the Coroners Act 1988 means coroners can relocate an inquest if it is in the best interest of the bereaved family and others, such as witnesses. The government said the move is part of a series of reforms aimed at putting the needs of the bereaved families at the heart of the processes.
