The purpose of this consultation is to seek views on a draft Statutory Instrument to implement those provisions within Regulation (EC) No. 765/2008 on accreditation and market surveillance that require national legislation to make them operable in the United Kingdom.


The purpose of this consultation is to seek views on a draft Statutory Instrument to implement those provisions within Regulation (EC) No. 765/2008 on accreditation and market surveillance that require national legislation to make them operable in the United Kingdom.

Areas for consultation

New powers of restriction, withdrawal and prohibition for certain public authorities in respect of products that do not comply with legislation in the Schedule to the SI.

New powers of recall and destruction/rendering inoperable for certain public authorities in respect of products that pose a serious risk (and within the Schedule to the SI).

Measures to safeguard HM Revenue and Customs’ information from misuse by those public authorities with new access to the information.

Protection for CE marking to ensure that it is only used on products that are within the scope of CE marking legislation.

Amendments to the General Product Safety Regulations 2005, the Electromagnetic Compatibility Regulations 2006 and the Personal Protective Equipment Regulations 2002.

The Impact Assessments for the Statutory Instrument.

This consultation is relevant to: businesses or individuals, Market Surveillance Authorities, and any other interested parties (such as healthcare professionals) that may be affected by the Government’s proposed approaches towards market surveillance in the UK.
