III.2) CONDITIONS FOR PARTICIPATION III.2.1) Information concerning the personal situation of the contractor, supplier or service provider and information and formalities necessary for the evaluation of the minimum economic, financial and technical capacity required Any supplier may be disqualified who: (a) is bankrupt or is being wound up, whose affairs are being administered by the court, who has entered into an arrangement with creditors or who is in any analogous situation arising from a similar procedure under national laws and regulations; (b) is the subject of proceedings for a declaration of bankruptcy, for an order for compulsory winding-up or administration by the court or for an arrangement with creditors or is the subject of any other similar proceedings under national laws or regulations; (c) has been convicted of an offence concerning his professional conduct by a judgement which has the force of res judicata; (d) has been guilty of grave professional misconduct proven by any means which the contracting authorities can justify; (e) has not fulfilled obligations relating to the payment of social security contributions in accordance with the legal provisions of the country in which he is established or those of the country of the contracting authority; (f) has not fulfilled obligations relating to the payment of taxes in accordance with the legal provisions of the country in which he is established or those of the country of the contracting authority; (g) is guilty of serious misrepresentation in supplying the information required under the provisions of the Directive on the criteria for qualitative selection; See III.2.1.3 for information to be submitted III.2.1.1) Legal position - means of proof required III.2.1.2) Economic and financial capacity - means of proof required Each applicant company, and each member of an applicant consortium, must provide ONE copy of its audited financial accounts for the previous three (3) years, including balance sheets and a statement of the firm's overall turnover, and of its turnover relating to the services specified at II.1.6 above. III.2.1.3) Technical capacity - means of proof required Applicants also must provide, in respect of their company or consortium, FOUR (4) copies of a concise document preferably no longer than 25 single sheets of A4 paper giving all of the following information:- (i) Company details including trading status (i.e. Plc/ Limited/partnership), if the applicant is a member of a group provide parent company details including their relationship, office from which the services will be provided and the location of all other offices. Date business commenced and name of trade or professional association(s) of which the applicant or its staff, are members; (ii) Human resources in the company including a statement of total numbers of professionally qualified staff and others, technical and specialist experience, CVs of key staff, including Directors, managers and others who are able to provide the services. Provide details of the number of permanent staff involved in delivering the services, and staff turnover as a percentage of your workforce for the last three (3) years; (iii) A list of at least three principal similar security type contracts (preferably public sector) undertaken in the last three (3) years in respect of the services. Examples should include contracts where a partnering ethos has been actively promoted. Provide details of the services actually provided by the company, the supply chain used/management arrangements, experience with TUPE transfers/issues arising, the sums, dates, and recipients of the services provided; (iv) An indication of any proportion of the contract which the service provider may intend to sub-contract. Provide full details of all sub-contractors intended; (v) Details of the applicant's facilities for carrying out the services including the policies and processes for implementing and managing the services, the integrated supply chain management, working methods applied, methodologies used for delivery and data systems used in managing the contract; (vi) Details of the quality management systems plus a copy of any accreditation certificate such as ISO 9001/EN, 2900/BS/5750, ISO 14001 or national equivalents; (vii) A copy of the certificates of professional indemnity and third party liability insurance arrangements; (viii) A statement of whether any of the circumstances described in Article 29 (a-g) of Directive 92/50/EEC (Regulation 14 of UK SI 1993No.3228) including but not limited to, environmental issues and health and safety, apply.
