Adoption - the new law

A report on how well CAFCASS and HMCS have responded to the implementation of the adoption aspects of the Adoption and Children Act 2002. This Act came into place on 30 December 2005 and represents the largest reform in adoption for more than 30 years.

Case administration in family proceedings courts

A 2001 MCSI review of case administration in Family Proceedings Courts. The review's objectives were to highlight gaps in statistical data available for private, public and adoption cases and identify key areas for measurement; to contribute to setting qualitative and quantitative standards in efficiency and effectiveness; to promote good and innovative practice; to highlight what helps and hinders good case administration; and to develop its inspection framework, specifically the case administration function, into an effective tool.

Children's guardians and care proceedings inspection report and leaflet

HMICA inspected section 31 care proceedings in Cafcass. The scope of the inspection was proceedings where interim or final care orders are sought by local authorities under the Children Act 1989.

Domestic violence, safety and family proceedings

A 2005 review of the handling of domestic violence issues by CAFCASS and the administration of family courts in HMCS. Although the criminal courts deal with prosecutions involving domestic violence, family courts and CAFCASS frequently deal with similar allegations. The inspection looked at how family courts handle such issues in their administrative arrangements. It also examined CAFCASS strategic management and its frontline practice when dealing with similar cases.

Managing CAFCASS: Corporate governance and strategy and performance management

Report on a 2004 inspection by MCSI into CAFCASS handling of corporate governance (working arrangements that ensure regularity, propriety, probity and accountability in all undertakings) and strategic management (how well it plans its services for the future and checks that the plans are followed). The report includes both Inspectorate recommendations and CAFCASS's action plans for implementing them.

National Assembly for Wales' functions concerning advisory and support services for family proceedings

In 2005, the CAFCASS Service in Wales was devolved to the Welsh Assembly Government. This 2006 report by MCSI, available both in English and Welsh, describes how well organisational change accompanying CAFCASS devolution has been achieved. It also points to areas where improvements are needed and to wider changes affecting family justice where the CAFCASS dimension will be crucial.

Private law front-line practice

An MCSI report on an inspection, between October 2005 and March 2006, into the work of CAFCASS practitioners in private law proceedings. The inspection focused on the quality of practitioners' work with children and families; the experience of service users during proceedings; the organisational accountability for the quality of practitioners' work; and arrangements to develop best practice and compliance with policies and procedures. The report includes both Inspectorate recommendations and CAFCASS's responses.

Safeguarding children in family proceedings April 2005

A 2005 report examining how well current CAFCASS arrangements work in safeguarding those children who are involved in family proceedings. The report draws together key issues around children's safeguards arising from MCSI's general programme of inspection of CAFCASS, and a specific programme of review visits to six care centres and linked magistrate's courts. It highlights areas for suggested action, although no formal recommendations are made.

A thematic review, published by MCSI in 2003, of the operation of schemes involving CAFCASS at an early stage in private law proceedings. Examines the arrangements in place across England and Wales to resolve disagreements about the future of children without recourse to a full court hearing.
