Terms and Conditions

1. Introduction

This Agreement is a legal document which sets out your rights and obligations, and those of the Landscape Character Network (LCN) in relation to this site and the services offered through it. By registering as a member of the LCN, you agree to the terms of this Agreement, and you re-affirm that agreement every time you use it. Visitors to the LCN website who do not register to become a member similarly affirm that they are bound by this Agreement each time they access the site.

2. LCN Member Registration

You undertake to register for the LCN using accurate and current information about yourself, including your correct name, address and any other requested details.

3. Privacy Policy

The LCN Privacy Policy forms part of this Agreement, and by agreeing to this Agreement, you also give your consent to the way we may handle your personal data in that policy. Given the global nature of the World Wide Web, any posting on the LCN discussion forum is, of course, accessible to internet users around the world.

4. Role of the LCN

You, whether you are a member of the LCN or a non-member who is visiting the LCN website, acknowledge that we are not and cannot be responsible for the behaviour of members - whether on the LCN website or outside of it. We only provide a venue where the LCN services may be accessed. In particular, you should be aware that the LCN does not pre-screen the material contributed by members on the discussion forum.

5. Operation of the LCN website

The LCN reserves the right to withdraw or modify one or more aspects of the LCN website where we have legal or technical reasons to do so (including technical difficulties experienced by the LCN or on the Internet). There may also be times when the LCN website becomes unavailable, whether on a scheduled or unscheduled basis. For security or other reasons, we may require you to change password or other information which facilitates access to the discussion forum.

6. Misuse of the LCN discussion forum

We reserve the right (a) to suspend or terminate any member's access to the LCN discussion forum, and/or (b) to edit, or require the member to edit, material posted on the LCN discussion forum, if the relevant member or material appears to us to be in breach of any provision of this Agreement. Any person whose access has been suspended or terminated must not re-register for, or re-access, the LCN discussion forum without our prior consent. You are responsible for everything which is done on or through the LCN discussion forum while your membership account is logged on. Furthermore, you must not use your access to the LCN discussion forum, or information gathered from it, for the sending of unsolicited bulk email (sometimes known as spam).

7. Prohibitions

You are responsible for ensuring that no material you post, or which is posted through a machine on which you access the LCN discussion forum, nor any activity or communication you make in connection with the LCN, will be capable of (a) infringing the intellectual property or other rights of any person or entity, (b) breaching any applicable law, whether criminal, tortious or otherwise, or (c) appearing to be offensive, threatening, obscene, pornographic, false, unreliable or misleading.

8. Alerting the LCN

If you see anything on the LCN discussion forum which appears to infringe this Agreement, then please contact us to inform us of it. We do not generally monitor material contributed by members before it is placed on the LCN discussion forum, and so we are reliant upon users to point out any which infringes this Agreement.

9. Withdrawal of material and Termination of Membership

Each member acknowledges that we are entitled to withdraw any material on the LCN website which appears whether based on information received from members or others, or our own determination to be capable of breaching any part of this Agreement, or to bring the LCN into disrepute.

10. Disclaimer and Release

The LCN has no control over or responsibility for the truth or accuracy of any material available on the LCN website, whether provided by members or others. Any views expressed in the discussion forum or elsewhere represent the opinions of the author, and do not represent the opinions of Natural England or Countryscape. If any third party sites are linked to from the LCN website, this does not mean that we endorse or have any responsibility for the site in question or anything which appears on it. Accordingly, to the extent that the law permits, you release the LCN, its sponsors, co-ordinators, contractors and employees from all liability arising out of or in connection with the LCN website and the material included here by members and other third parties.

11. Intellectual Property

By submitting any material to the content of the LCN website, you:
• are representing that you are fully entitled to do so;
• grant us, and other LCN members, a non-exclusive, royalty-free, non-terminable licence right to copy, modify, distribute, show in public and create derivative works from that material in any form, anywhere.

12. Indemnity

You agree to indemnify us against all liabilities, claims and expenses that may arise from any breach of this Agreement by you or through a machine on which you access the LCN website. The LCN will also not be liable for any failure to perform of its obligations under this Agreement caused by matters beyond its reasonable control.

13. Entire Agreement

This Agreement includes our privacy policy. Together they contain the whole of the agreement between us and you concerning the LCN website. A person who is not a party to this Agreement has no right under the Contracts (Rights of Third Parties) Act 1999 to rely upon or enforce any term of this Agreement.

14. Changes to this Agreement

The LCN reserves the right to change this Agreement from time to time, and post the new version on the LCN website. When we do so, we will notify you of the fact that there are changed terms, and the new version of these terms and conditions will take effect, and will govern all LCN services and your relationship with the LCN.


Privacy Policy

1. Introduction

This is a legal document which sets out how the LCN handles data which identifies you. You should read it in conjunction with the LCN Terms and Conditions, of which this Privacy Policy forms part.

The LCN believes strongly in protecting the privacy of its members' personal information. This statement describes the privacy practices we apply for the LCN membership. As part of that, it also expresses our approach to complying with the data protection laws which apply in the United Kingdom. If we change this Privacy Policy, we will notify you of the changed document in the same way as we notify changes to the LCN Terms and Conditions.

2. The information we gather and track.

• Information gathered on registration
The information you provide when registering as a member of the LCN is available to you, and capable of being changed, by contacting the LCN.
• Cookies
A cookie is a piece of data stored locally on your computer and contains information about your activities on the Internet. The information on a cookie is not linked to any personally identifiable information you submit to our site. Once you close your browser, our access to the cookie terminates. If you choose not to accept the cookie, you will not be able to log on to the discussion forum.

3. Sharing and use of information

The over-riding principles we apply are these:
• We will not supply your personal data to a third party for commercial exploitation, thus, you can rest assured that we will not sell the lists of our members' email addresses to a third party.
• We do not directly make your email address available to anyone on any screen of the LCN website.

4. Security

We have security measures in place to protect our member database and access to this database is restricted internally. However, it remains each member's responsibility:
• to protect against unauthorised access to your username and password for the discussion forum;
• to log off from the LCN discussion forum when not using it.

5. Opt-out policy

You may have your membership details removed at any time by contacting the LCN.

6. Disclosure for legal reasons

We reserve the right to communicate such of a member's personal information as we hold to third parties which seek the disclosure of it, and which make a legally-compliant request for its disclosure.

7. Links to third party sites

Our site contains links to other sites. The LCN is not responsible for the privacy practices, or the content, of those web sites.
