Information that is not published or made available on request
There are 22 exemptions under the Freedom of Information Act. Eight are absolute exemptions; the other 16 are known as qualified exemptions, where SITPRO must decide whether the public interest is better served by the disclosure or the withholding of the information.
In circumstances that arise under sections 21 to 44 of the Freedom of Information Act, SITPRO may be entitled to claim exemptions, which will negate the requirement to provide information that falls within the exemptions. SITPRO aims to be open and transparent about its work but there are some exceptions. Information will not be published where, in SITPRO’s view there are issues of commercialism sensitivity, unwarranted invasion of privacy or confidentiality. It should be noted that disclosure of personal information will continue to be governed by the Data Protection Act 1998.
Additionally, information that is in draft form prior to a planned publication and information that has been archived will not be published through this scheme.
More details about the exemptions are available at www.informationcommissioner.gov.uk. There are similar exemptions from disclosure under the Environmental Information Regulations, which are known as exceptions.
