The South East Plan

The Secretary of State published the final version of the South East Plan (also known as the Regional Spatial Strategy for the South East) on May 6 2009. This replaced the Regional Planning Guidance for the South East (RPG9).

Six legal challenges to the Plan were received within the statutory six week period allowed for such challenges:

  • One of the challenges related to Policy H2 bullet point (i) which refers to how Growth Points and eco-towns should be assessed in the RSS
  • one to the policy for a selective review of the Green Belt to the north east of Guildford, and
  • four to the policy for a selective review of the Green Belt to the south of Oxford

The wording of bullet point (i) of Policy H2 that appeared in the final Plan was different from that issued at the Proposed Changes stage, but contrary to statutory requirement, no explanation of this change appeared in the Schedule of Reasons for Changes published as part of the accompanying Supporting Document. The altered wording appeared in the published Plan as a result of an administrative error. Arun District Council mounted a legal challenge about the wording, and Government immediately conceded that the wording was incorrect and should be quashed by the High Court.

We have now received the Sealed Consent Order from the Court confirming that bullet point (i) of Policy H2 of the published South East Plan is deleted. However, the rest of the policy remains in force as published. A letter detailing the deletion and explaining the status of the rest of the Plan has been sent to all Chief Planning Officers in the South East.

Government is considering its position on the remaining challenges.
