Mental capacity

This section provides information and guidance on dealing with mental capacity issues and the new Mental Capacity Act 2005 which will come into effect in England and Wales during 2007. The Act received Royal Assent on 7 April 2005.

Who the Mental Capacity Act affects

The Act affects everyone aged 16 and over and provides a statutory framework to empower and protect people who may not be able to make some decisions for themselves, for example, people with dementia, learning disabilities, mental health problems, stroke or brain injuries.
