Greater Choice for the Australian Automotive Industry as VCA Opens New Office in Melbourne

Melbourne - Australia's flourishing automotive industry will now have support from a leading European testing and certification body as the UK's approval authority, VCA, opens a new office in Melbourne.

The launch took place on the 1st July 2008 at the headquarters of the Department of Innovation, Industry and Regional Development (DIIRD) in Melbourne and was well attended by industry representatives. The Executive Director of DIIRD, Mr. Ray Doyle, introduced VCA and VCA's CEO, Paul Markwick, went on to speak of his hopes for the future of VCA Australia. VCA already supports a number of major manufacturers in the region and a dedicated presence in Melbourne will provide an even more responsive service to both existing and new customers.

VCA's CEO, Paul Markwick went on to say, "VCA has supported the automotive industry for more than 30 years and as it has become more global in nature, we have evolved and expanded to meet the needs of an ever-changing client base. This expansion has led us into a number of overseas territories and our Melbourne base is the latest in our portfolio. The Australian automotive industry is a very important part of the overall economy and has become increasingly export focussed. I very much hope our presence in the region will help to support industry in its drive to access European markets. The office will be run by one of our most experienced expert engineers, Howard Danielson. Howard has been instrumental in the success of other overseas offices such as the US, Japan and Malaysia; I know he is looking forward to the challenges ahead".

Holden's spokesman commented, "GM Holden congratulates VCA on the opening of their Melbourne office. As one of the larger Type Approval agencies, VCA brings considerable experience to our Industry. We look forward to working with the Australian VCA office and wish them every success for the future."

Enforcement Body brings first prosecution

26th November 2007, Caerphilly Magistrates Court saw the successful prosecution of Simon Tullett Machinery on 3 charges of non-compliance under legislation controlling the noise emissions of equipment designed for use outdoors. The legislation has been in force since 2002 and VCA is the nominated enforcement body. VCA also enforce the Non-Road Mobile Machinery Regulations for Exhaust gaseous emissions, the equipment under both sets of legislation being similar.

Speaking of its first prosecution under this legislation, a VCA spokesperson said, "This legislation has been in place for some time now and despite a programme to raise awareness we are still finding cases of non-compliance and this is not acceptable. It is our intention to take a much more robust stance against companies who fail to bring their products into compliance".

In this particular case a fine was levied on each of the counts and VCA was awarded costs.

The EC Noise emission in the environment by equipment for use outdoors Directive was adopted by the European Parliament and the Council on 3 July 2000 as Directive 2000/14/EC. The Directive arises from the European Community's (EC) programme for the elimination of technical barriers to trade and is formulated under the 'Global Approach'. Its purpose is to harmonise national laws of Member States regarding noise emission limits and labelling requirements at the manufacturing stage.

VCA was authorised by the Department for Business, Enterprise, & Regulatory Reform (formerly the Department of Trade and Industry) to carry out inspections at retailers and importers premises to identify items of equipment covered by this legislation that do not conform. Additionally, VCA carries out noise level testing on samples of equipment to check the accuracy of noise levels claimed. The Directive was implemented into UK law by The Noise Emission in the Environment by Equipment for use Outdoors Regulations 2001 (SI 2001/1701) made under the European Communities Act 1972.

The Regulations apply to more than 50 types of equipment for use outdoors ranging from construction machinery to lawnmowers. Noise emission measurements are required to be shown on a label fixed to the machine, which is taken as the "guaranteed" noise level for a given machine. In addition, the Regulations set noise limits for 22 of the categories, which are laid down in two stages.

WEEE Regulations take effect on 1st July 2007

1st July 2007 was a significant day from an environmental perspective because it signalled greater choice for those consumers wishing to dispose of domestic Waste Electric and Electronic Equipment (WEEE) in a more responsible way.

From 1st July, distributors of electrical and electronic equipment will have to provide facilities for their customers to return old electrical equipment when they buy a replacement item. Distributors, including distance sellers (such as those who rely on the Internet), have two options:

1. They can either join the Distributor Take-Back Scheme (DTS), which supports a network of primarily local authority collection points where customers can return their waste electricals.

2. Or they can allow customers to bring goods back to the store.

Whether retailers are members of the DTS scheme or provide take-back in store facilities, distributors also have to make information available to consumers on how they can dispose of WEEE and the environmental benefits of doing so.

The requirements are given in the Waste Electrical and Electronic Equipment (WEEE) Regulations (SI 2006 No. 3289), which also details obligations on producers to ensure that affected equipment is marked to encourage responsible disposal.

On 18th May 2007, The Science and Innovation Minister, Malcolm Wicks, announced the appointment of the Vehicle Certification Agency (VCA) as the enforcement body for the distributor obligations under the Waste Electrical and Electronic Equipment (WEEE) Regulations.

Mr Wicks said:
"This agency has an important role to play in ensuring that distributors comply with their obligations under the WEEE Regulations. Free-riding will not be tolerated, and a robust process will be in place to serve notice and ultimately prosecute distributors who are unwilling to become compliant".

Speaking of the appointment VCA's CEO, Paul Markwick said, "We have a significant amount of experience in the enforcement arena, a fact clearly recognised in our appointment. Our team of experienced enforcement officers will be on hand to ensure that legal obligations are met".

The WEEE Directive (2002/96/EC, as amended 2003/108/EC) aims to address the environmental impact of Electrical and Electronic Equipment (EEE) and to promote its separate collection when it becomes waste (WEEE). WEEE is a priority waste stream for the EU because of its growing volume in the municipal waste stream and its potential hazardousness following disposal.

The Directive introduces producer responsibility for waste Electrical and Electronic Equipment (WEEE). Producers will have to finance treatment and recycling/recovery of separately collected WEEE in the UK to specified treatment standards and recycling/recovery targets. Retailers have an obligation to offer take-back services to householders. The Directive does not place any obligations on householders, and they will not be prohibited from throwing WEEE away with general domestic rubbish. It will however encourage more WEEE to be reused or recycled by ensuring that there is a network of facilities in place where householders can return their used equipment free of charge.
