Amendments to the products of animal origin (third country imports) (England) regulations 2006 and the animals and animal products (import and export) regulations 2006

Purpose

To advise you of amendments to the Products of Animal Origin (Third Country Imports) (England) Regulations 2006 (POAO TCI) and the Animals and Animal Products (Import and Export) Regulations 2006 (AAP).  The amendments came into force on 15 January.

Background

The above Regulations have been amended as follows:

  • Update to Schedule 1 of POAO TCI;
  • Update to Schedule 2 of AAP;
  • Update to Schedule 3 of AAP
  • Update to Schedule 7 of AAP
  • Miscellaneous small changes to AAP 2006

In addition, the references to Community legislation in Schedule 1 of POAO TCI and in Schedules 3 and 7 of AAP are now ambulatory.  This means that if any EU Decision, Directive or Regulation is listed in these Schedules and is subsequently amended by EU legislation, the amending EU rules will be automatically enforceable in England without need for further amendment to POAO TCI and AAP.

Where a Decision, Directive or Regulation is repealed and/or replaced that new piece of EU legislation will only be implemented in English legislation if the relevant Schedule is updated.
