                                                                                                                                                                 28 February 2003

Dear Sir/Madam

DRAFT LOCAL GOVERNMENT PENSION SCHEME (AMENDMENT) REGULATION 2003

With the Minister’s agreement, I enclose, draft regulations that amend the Local Government Pension Scheme Regulations 1997. Your comments are invited no later than 11 April 2003.

The proposed amendments are to take account of new entitlements to paternity and adoption leave provided for by the Employment Act 2002 which come into force on 6th April 2003. The new entitlements, among other matters, set out how such leave is to be treated for the purposes of accruing membership in the LGPS. The amendments concern a member who is either on adoption or paternity leave, and they set out when contributions are to be made and whether membership is counted as continuous.

Responses, and any initial queries should be directed to Catherine Bruckard, Local Government Pensions Division, ODPM, Zone 2/F8, Ashdown House, 123 Victoria Street, London, SW1E 6DE (tel 020 7944 6003).

The Department may wish to publish responses to this consultation in due course, or deposit them in the libraries of the Houses of Parliament or the Department’s library, unless we are asked specifically to treat a response as confidential. Confidential responses will be included in any published statistical summary of comments received and views expressed.

Yours faithfully,
