The Local Government Pension Scheme (Amendment No. 3)

The Secretary of State, in exercise of the powers conferred on him by sections 7 and 12 of the Superannuation Act 1972() and of all other powers enabling him in that behalf, after consultation with such associations of local authorities as appeared to him to be concerned, the local authorities with whom consultation appeared to him to be desirable and such representatives of other persons likely to be affected by the Regulations as appeared to him to be appropriate, hereby makes the following Regulations: -
Citation and commencement
1. - (1) These Regulations may be cited as the Local Government Pension Scheme (Amendment No.3) Regulations 2001.
(2) These Regulations shall come into force on 2001 but-
Amendment of Regulations
2. The Local Government Pension Scheme Regulations 1997() shall be amended in accordance with regulations 3 to 9 of these Regulations.
Agreements to enable employees of non-Scheme employers to be members ("admission agreements")
3. In regulation 5(17)(j), after "which is a Scheme employer" insert "or an admission body approved for this purpose by the Secretary of State".
Meaning of "pay"
4. In regulation 13(2)-
(a) delete "or" at the end of sub-paragraph (f); and
(b) after sub-paragraph (g) add-
"; or
(h) a payment made in consequence of a School Achievement Award, being a payment granted in respect of a school, in recognition of excellence or improvement, under the scheme established by the Secretary of State known as the School Achievement Award Scheme".
Amounts of ill-health pension and grant
5. In regulation 28-
(a) in paragraph (5), for "but see paragraph (8)" substitute "but see paragraphs (5A) and (8)"; and
(b) after paragraph (5), insert the following new paragraph-
"(5A) His enhanced membership period must not be reduced below that which is calculated by reference to his membership in whole-time employment, disregarding his membership in part-time employment.".
Reduction of death grants: re-employed pensioners
6. Delete regulation 39.
Inward transfers of pension rights
7. In regulation 121(9) after "credit it to their pension fund" add "but a transfer value in respect of the rights specified in paragraph (2)(e) must be invested with the AVCs the member pays under the Scheme".
Schedule 2 Scheme Employers
8. In Schedule 2, add-
"A body set up by a local authority under powers under section 2 of the Local Government Act 2000() as an arms length housing management company to manage functions delegated to that body by the local authority under an arrangement approved by the Secretary of State under section 27 of the Housing Act 1985()".
Schedule 3 Excluded membership
9. Delete paragraph 2, columns 1 and 2 in the Table in Schedule 3.
