The Government intends very shortly to bring forward amendments which will introduce clauses to the Bill restating further
provisions of the 1985 and 1989 Acts. Drafts are available to download below, including a table of derivations and destinations
to help show how the clauses relate to the existing law. (The asterisks in the tables of derivations refers to provisions
where there are changes to bring them into line with the Bill's approach in some way).
There will then be an opportunity to review the drafting of the clauses over the summer, and the Government will, in particular,
seek views from the Law Societies and others. If, in the light of that consideration, it becomes clear that any unintended
changes to the law have been made as part of the restatement exercise, these could be corrected through amendments brought
forward at Report stage.
While any immediate reactions to the clauses would of course be welcomed, considered views on the drafting are invited by
Friday 8 September, to companylawreform@dti.gsi.gov.uk using the phrase "Comments on the draft restatement clauses" in the subject box of the email and also in the heading of any
attachments.
