Implementation of the Distance Marketing of Consumer Financial Services Directive

The implementation of the Distance Marketing of Consumer Financial Services Directive (“the DMD”) sets common standards for the information that must be supplied to consumers of financial services prior to a contract being concluded at a distance, where the supplier makes exclusive use of one or more means of distance communication (e.g. telephone, internet, fax or mail). There are also provisions for rights of withdrawal (“cancellation rights”) in many circumstances. The aim is to enhance the working of a single market by giving consumers the confidence to buy products on a cross border basis, with providers being governed by a common set of core standards across the European Union.
