Introduction
This document
is designed to inform trade unions, their members, and others
about certain statutory rights and duties in relation to union
funds, property and accounting records which have been introduced
since 1988. There are a number of steps which a union member may
take if he is concerned about the financial affairs of a trade
union, and these steps should be set out in the statement to members.
In particular, a member can raise any concern with:
- the officials
of the union;
- the trustees
of the union’s property;
- the auditor
or auditors of the union;
- the independent
Certification Officer.
A union member
can also consider bringing civil proceedings against the union
or responsible officials or trustees, or where he is concerned
that a criminal offence has been committed, he can raise such
concerns with the police.
Other rights
and duties in respect of funds and accounts which apply by virtue
of a union’s rulebook are not covered in this document, but a
union member may complain to the Certification Officer or the
court to enforce them.
This document
describes the relevant statutory rights and duties.

The contents
of this document apply equally to men and women but, for simplicity,
the masculine pronoun is used throughout. ‘Court’ means the High
Court in England and Wales and Court of Session in Scotland.
