Consultation Paper on Guidance to draft Codes of Practice to Minimise Noise

Under section 71 of the Control of Pollution Act 1974 the Secretary of State for Environment, Food and Rural Affairs (Defra) can approve codes of practice to minimise noise. The purpose of the consultation paper is to provide guidance on how to develop codes of practice to minimise noise. It sets out considerations which should be taken into account and recommends the procedures which should be followed if the code is to be submitted for approval. It is particularly important that the procedures are followed as the Secretary of State will be unable to approve a code unless she is satisfied that the necessary consultation has been carried out, especially since the courts will take into account these codes when making their decisions.

This guidance relates only to England. The National Assembly for Wales and Scottish Executive will be consulting separately in Wales and Scotland.
