Note: This consultation has now closed. The final Code of Practice is now available via this link. The following material has been left in place for reference/archive purposes.
Under the Groundwater Regulations 1998 ministers may approve codes of practice for activities which could result in pollution of groundwater. To this end, a draft groundwater protection code (Adobe Acrobat format - 330kb) for petrol stations and other fuel dispensing facilities involving underground storage tanks (USTs) has been drawn up by the Department's consultants. The code is intended to assist users in preventing groundwater pollution from USTs and to help those involved with such facilities to comply with the legal requirements of the Regulations. It gives guidance on the performance criteria which would need to be met to demonstrate compliance with the Regulations. Details of the requirements of the Regulations are set out in the Code.
The code is not intended to cover health and safety issues and does not, therefore, replace other codes or guidance addressing such matters. Similarly the code is not meant to replace technical guidance available on engineering solutions, though comment is given, where relevant, to the sorts of solution which may be available.
The document has been made available in Adobe Acrobat format for downloading. The Adobe Acrobat Reader can be freely downloaded. Viewers with visual difficulties may find it useful to investigate services provided to improve the accessibility of Acrobat documents -- http://access.adobe.com
Responses
It is important that the code effectively addresses risks to groundwater and that it does so in a way which is clear and practicable. Defra therefore wishes to draw on the knowledge and views of the target audience for the code - in particular, those owning, operating, designing or decommissioning USTs - as well as those who have an interest in groundwater protection. If you have any comments on the code, please send them by 19 October to our consultants, WS Atkins, as follows:
