This Call for Evidence seeks views from UK stakeholders on recent proposals from the European Commission on consumer alternative dispute resolution. In summary, the Commission argue that all EU consumers should be able to solve their problems without going to court, regardless of the kind of product or service that the contractual dispute is about and regardless of where they bought it in the European Single Market. In addition, for consumers shopping online and from another EU country, the Commission want to create an EU-wide single online platform which will allow contractual disputes to be solved entirely online and within 30 days. The proposals are likely to impact UK consumers, businesses and organisations that currently provide alternative dispute resolution services. Views are sought on the likely scale of these impacts. Views received will help form the UK’s negotiating position.

A consultation paper seeking views on proposed reforms to the structure of the Financial Reporting Council has been published. Responses due by 10 January 2012.
BIS and FRC consulted jointly on proposals to reform the FRC. The proposals were designed to clarify the FRC’s scope, streamline its governance and structure, and give it greater independence from the accountancy profession and a proportionate range of sanctions against poor quality auditing.
The response to the consultation helped the Department and the FRC refine the proposals. In particular the proposals have been amended to enhance the status of the expert groups that will advise the FRC Board on accounting, auditing and actuarial issues and to make clear the procedural safeguards that will be put in place as part of the FRC’s monitoring and enforcement work.
The Government intends, subject to Parliamentary approval, to bring forward secondary legislation for changes to come into force from Monday, 2nd July 2012.

Following the Government's consultation, we are proposing to create a new Competition and Markets Authority that brings the Competition Commission and the OFT’s competition functions into a single organisation and to modernise its competition toolkit. The creation of a single Authority will enable us to eliminate inefficiency and unnecessary duplication in our markets and mergers regime . It will also ensure that we have a single organisation with the right powers and flexibility to use the best processes in tackling competition problems, and one that can help business understand their competition law obligations. Resource allocation will be improved, and business will benefit from having just one, streamlined organisation that helps them to understand and comply with competition law.

The review of offender learning announced by John Hayes, Minister of State for Further Education, Skills and Lifelong Learning, will assess progress against the policy framework set out in the Next Steps document and make recommendations to improve the efficiency and effectiveness of the arrangements. The review, undertaken jointly with the National Offender Management Service, is taking full account of the earlier strategic review of employment services for offenders (undertaken jointly between the Department for Work and Pensions and the Ministry of Justice), and will inform the Ministry of Justice’s Autumn Green Paper setting out the proposed approach to sentencing and rehabilitation reform.

Skills conditionality involves Jobcentre Plus referring claimants to a skills training provider, further education college or Next Step adviser with potential benefit sanctions for non-participation. The training will include vocational, basic skills, employability training as well as support with softer skills such as motivation and confidence building.
