Your Deputyship Order, or a clause in it, may contain a time limit after which it will expire and can no longer be used. This is particularly significant if your order was made in 2007 and you previously acted as a receiver. However, some newer orders may also include a time limit.
It is therefore essential that you check your order as soon as possible.
If your order does contain a time limit and is due to expire shortly, you should, where appropriate, submit an application for a fresh order to the Court of Protection.
Any such application should be made on Court form COP1 and will normally need to be supported by:
If the Order has already expired, a COP4 (Deputy’s declaration) form will also be needed.

An application fee of £400 will also be applicable unless the conditions for exemption or remission of fees apply.
In most cases the Court is currently issuing orders within 14 weeks of receipt of an application.

As from today, the Court Funds Office will no longer be running a counter service to the public. There will be a two week period of grace where the CFO will continue to accept counter payments to assist phasing out the service.
Customers wishing to make a payment into court from 1 April will need to send a cheque or bankers draft made payable to the “Accountant General of the Senior Courts” by post.
Litigants in person without a current bank account may make cash payments at the county court or District Registry in which their case is taking place.
Litigants in person without a current bank account whose case is taking place at the Royal Courts of Justice, and anyone wishing to pay security for costs in election petition proceedings, may make a payment in cash at the Mayor’s and City of London Court.

Court Funds Office Modernisation
The CFO are hoping to work with National Savings and Investments (NS&I) to modernise CFO. The proposal to involve NS&I in the CFO is purely administrative. The MoJ, and specifically the Accountant General, will maintain overall responsibility for funds held in court.
However, before any transfer of work can take place, legislation needs to be amended to formally increase NS&I’s scope to take on the additional work. This change will be part of the Financial Services Bill which will feature in the Queen’s Speech and will go before Parliament shortly afterwards. Subject to Parliament’s approval, the Bill should become law around April 2010.
CFO itself will continue to exist and customers will continue to deal with CFO as a public facing body.
