The strengths and skills of the Judiciary in the Magistrates’ Courts

This research assessed the strengths and skills of magistrates and District Judges to inform better deployment of the judiciary in magistrates’ courts.

Qualitative research was conducted involving the judiciary, court staff and court users. Observations of 2,291 court cases in 44 courts collected quantitative data, which was subject to data modelling to ensure fair comparisons between magistrates and District Judges.

The observation data indicated that differences between magistrates and District Judges were not as marked as indicated in the qualitative research. However, efficiencies could be made if District Judges were deployed for more difficult and complex cases.
