Confidence and confidentiality: openness in family courts - a new approach

This is the second consultation on improving openness in family courts. This paper set out what we are taking forward from the last consultation, and sought views on new proposals to improve the openness in family courts.

The previous consultation paper titled Confidence and confidentiality: Improving transparency and privacy in family courts was published by the Department for Constitutional Affairs in July 2006.

Responses

There were 112 responses to the consultation from a wide range of respondents. We have decided the way forward on the basis of responses to the first and second consultation, conversations with experts and professionals across the field of family justice, and many letters received by the department.

The way forward is based on three key principles:

1. to improve confidence
2. to protect the interests of children and vulnerable adults
3. to enable more access to support.
