Amendments to the Family Proceedings Rules 1991

This consultation sought views on draft court rules and forms to support the implementation of the remaining provisions of the Children and Adoption Act 2006. These enable courts to use contact activities to help resolve child contact disputes and give them more flexible powers to enforce contact orders.

The consultation is on a draft statutory instrument, made by the Family Proceedings Rule Committee under the provisions of section 40(1) and (4)(aa) of the Matrimonial and Family Proceedings Act 1984.

The draft statutory instrument contains the court rules to support the implementation of the provisions for contact activity directions and conditions and more flexible powers for the courts to enforce orders for contact with a child introduced by the Children and Adoption Act 2006. It also contains the application forms for applications for enforcement orders in connection with child contact orders and for orders for financial compensation, and the draft forms for orders made under the provisions of the 2006 Act, which form part of the rules.

Responses

There were 25 responses to the consultation. Respondents were generally content with the detailed provisions of the rules, although some raised questions in relation to the effect of some of the provisions and the general policy behind the Act. There were a number of detailed comments on the draft application forms and the draft order forms, and a number of amendments have been made as a result.

The remaining provisions of Part 1 of the Children and Adoption Act 2006 came into force on 8 December 2008.
