Mental capacity
The Mental Capacity Act 2005 provides a statutory framework for doing this.
The Office of the Public Guardian, an executive agency sponsored by the Ministry of Justice, is responsible for the Mental Capacity Act 2005 along with the Department of Health and the Welsh Assembly Government. The Office of the Public Guardian is also responsible for providing information and guidance to individuals and their families, social and healthcare professionals and legal practitioners on all aspects of mental capacity policy.
