Consultation Document for Commission Proposal on Certain Procedural Rights During Criminal Proceedings Throughout the European Union

This consultation paper invites comments from interested parties on a European Commission proposal for a Council Framework Decision on certain procedural rights during criminal proceedings throughout the EU. A copy of the proposal is attached.

The proposal seeks to define the rights of suspects and defendants through a set of common minimum standards in the safeguarding of procedural rights during criminal proceedings, to facilitate the application of the principle of mutual recognition. The proposals apply from the moment when a suspect is informed that they are suspected of a crime until a final judgement is made. The draft Framework Decision focuses on access to legal assistance and representation, state funding of legal assistance, interpretation and translation, the protection of vulnerable people, the right of communication and a Letter of Rights.
