Conditional Cautioning Code of Practice
This Code of Practice governs the use by police of Conditional Cautions, under the Criminal Justice Act 2003.
Conditional Cautioning enables offenders to be dealt with appropriately without the involvement of the usual court processes. The key to determining whether a Conditional Caution should be given – instead of prosecution or a simple caution – is that the conditions attached to the caution will be an appropriate and effective means of addressing the offender’s behaviour or making reparation for the effects of the offence on the victim or the community.
In February 2004 we published a consultation paper on the draft Code of Practice for Conditional Cautioning, inviting views from interested parties. Those contributions were considered and the draft Code was amended accordingly before being finalised and laid before Parliament, as below:
