Extradition

Extradition is the return of a wanted criminal from a country where he or she is found, to the country where he or she is accused of, or has been convicted of, a criminal offence. It is to be distinguished from deportation, which is concerned with the removal of an individual from a national territory.

Extradition Section

The Extradition Section is part of the Organised Crime, Drugs and International Group.

Its function is to process extradition requests to and from the United Kingdom; advising Ministers on action they need to take in each case and on extradition policy and arrangements with other countries.

Extradition Procedures in the United Kingdom
This Home Office note outlines the main stages and procedures in extradition requests made to the United Kingdom. It is intended simply as an introduction to a complex subject; it is neither comprehensive nor a statement of law. This guide does not explain the procedures for Scotland which, because of its separate legal system, are slightly different from those for the rest of the United Kingdom. A separate guide to Scottish procedure will be forthcoming on the Scottish Executive website.

European Union Extradition Regulations 2002
The European Union Extradition Regulations 2002 (SI2002/419) came into force on 20 March 2002. They give effect to the 1995 Convention on Simplified Extradition Procedures between Member States of the European Union and the 1996 Convention Relating to Extradition between Member States of the European Union. The two Conventions modify the European Convention on Extradition (ECE) so far as the European Union Member States are concerned.
