This is the forty-first bulletin covering developments on the Financial Services and Markets Act 2000 (FSMA).
Two year review of FSMA – Revised draft legislation for public comment
In the Treasury’s feedback statement ‘Financial Services and Markets Act, two year review: changes to secondary legislation, Government response’, published on 2 December 2004, the Treasury stated its intention to publish revised drafts of all FSMA 2000 two year review legislation early this year prior to adoption of the legislation (with the exception of legislation relating to future work requiring further public consultation). FSMA bulletin number 40, issued on 19 January 2005, enclosed four of the eight revised draft Statutory Instruments, which make up the legislation, for public comment by 27 January 2005.
This bulletin encloses three further revised draft Statutory Instruments. Please find these at the links below:
- The Financial Services and Markets Act 2000 (Financial Promotion) Order 2005 . This relates to the policy conclusions in Chapters 3, 4 & 5 of the Treasury’s feedback statement. Please also find the Treasury’s explanation of the ‘Principal Amendments to the Financial Promotion Order’ . (To note this explanation does not form part of the revised draft legislation itself).
- The Financial Services and Markets Act 2000 (Regulated Activities) (Amendment) Order 2005 . This relates to the policy conclusions in Chapter 8, in particular paragraphs 8.1 to 8.3, of the Treasury’s feedback statement
- The Financial Services and Markets Act 2000 (Exemption) (Amendment) Order 2005 . This relates to the policy conclusions in Chapter 9, paragraphs 9.7 to 9.9, of the Treasury’s feedback statement.
The Treasury invites public comments of a purely drafting or legal nature on the above revised draft legislation. All comments must be received by 10 February 2005 at the latest. Comments should be sent to:
