FINANCIAL SERVICES AND MARKETS ACT 2000: RECENT DEVELOPMENTS

This is the twenty-eighth bulletin covering developments on the Financial Services and Markets Act 2000 (FSMA).
Implementation of the E-Commerce Directive
Two of the statutory instruments implementing the E-Commerce Directive in Financial Services have now been made and will come into force on 21 August. These are:

The Financial Services and Markets Act 2000 (Regulated Activities) (Amendment)(No. 2) Order 2002;
-
The Electronic Commerce Directive (Financial Services and Markets) Regulations 2002.
They are available in the E-Commerce Directive section of this site, together with a response to the public consultations of December 2001 and March 2002.
Two further statutory instruments will be made at a later date, namely:

The Financial Services and Markets Act 2000 (Financial Promotion) (Amendment) (Electronic Commerce Directive) Order 2002;
-
The Electronic Commerce Directive (Financial Services and Markets) (Amendment) Regulations 2002.
Laying of secondary legislation under FSMA
SI 2002 No. 1409 The Financial Services and Markets Act 2000 (Consequential Amendments)(Taxes) Order 2002.
Mortgages
The Financial Services and Markets Act 2000 (Commencement of Mortgage Regulation) (Amendment) Order 2002 will be made shortly. It will repeal the date specified for the commencement of mortgage regulation in earlier statutory instruments, and provide instead that regulation will commence on a date to be announced in the London, Edinburgh and Belfast Gazettes.
