EXPLANATORY NOTE

SUMMARY

1. The purpose of these amendments is to provide specific Scottish translations of the England and Wales terminology and to clarify the position of Scottish missives of let.

DETAILS OF THE AMENDMENT

2. Amendments 199 and 201 add a new paragraph (c) to subsection (9C) of section 587B, which deals with the application of the provisions to Scotland.  It makes clear that references to an agreement for a lease do not include missives of let which constitute an actual lease.

3. Amendment 200 replaces the words in subsection (9C)(b), "the interest of a tenant", with the correct Scottish terminology, "a tenant's right over or interest".
