Public Inquiry

On 25 January 2007, the Secretary of State for Transport announced that a Public Inquiry would be held into the objections and representations received in response to the publication of draft Orders for the scheme.

The Public Inquiry into the M40 Junction 15 (Longbridge) Bypass was held at The Hilton Hotel, A429 Stratford Road, Warwick. The Inquiry was adjourned on the 23rd of March and reconvened at the same address on Tuesday 8th May 2007. The Inquiry was closed on the 8th May 2007 at 16:52. The Secretaries' of State Decision letter was published on 20th December 2007.

The Secretaries' of State decision on highway orders, following the local inquiry with copy of Inspector's report can be accessed on the DfT website. 

The Orders were published on 11 January 2008. ANY PERSON AGGRIEVED by an Order who desires to question its validity, or the validity of any provision in it, on the ground that:

a) it is not within the powers of the Highways Act 1980, or

b) any requirement of that Act or of regulations made under that Act has not been complied with in relation to that Order

may apply to the High Court within 6 weeks from the date of first publication of this notice. On such an application, the Court may suspend or quash that Order or any provision in it.

The 6 week High Court challenge period ended on 25 February 2008. There were no challenges to the Made Orders and the early phase of work started on 3 March 2008.
