The Government’s Final Response to ECGD’s consultation on changes to its anti-bribery and corruption procedures introduced in December 2004 is published today.

ECGD thanks all those that submitted representations in the course of the two rounds of public consultation. All consultees’ views have been carefully considered. The Government’s key concern throughout has been to ensure that ECGD’s procedures are rigorous yet workable.

The Final Response (PDF 121 KB) now requires that UK exporters and investors applying for ECGD support must provide the identities of their agents (or other intermediaries involved in the award of the contract). A number of representations to the consultation stressed to ECGD the commercial sensitivity of information about agents’ identities.
Annex C (PDF 78 KB) of the Final Response sets out a proposal for a system to be observed in handling information about agents’ identities.

ECGD welcomes any comments about these handling arrangements, which will be introduced alongside the changes to the procedures. Details of how to provide such comments can be found at Annex D (PDF 71.7 KB) of the Final Response. Please note that the deadline for providing comments on the proposed special handling arrangements has been extended to the 30 April 2006.

ECGD will make a number of changes to its December 2004 procedures. As recommended under Cabinet Office guidelines, there will be an implementation period to give applicants for support a reasonable period to prepare for the changes. The revised procedures will therefore come into effect on 1 July 2006.

The Government’s Concluding Response to ECGD’s consultation on  its Anti-Bribery and Corruption procedures was published on 9 June 2006.

This follows publication on 16 March 2006 of the Government’s Final Response to the consultation. During the consultation, which finished on 18 November, some exporters expressed concerns that disclosure of commercially confidential information could harm their business. On 16 March the Government extended the consultation until 30 April to get views on this final issue. Consultees were invited to comment on ECGD’s proposals for handling information about the identities of agents, information which will be required as part of every application, in order to minimise the risk of inadvertent disclosure of that information.

The results of this consultation are set out in the Concluding Response. The procedures for handling agents’ identities, known as the ‘Special Handling Arrangements’, will come into effect as part of ECGD’s new anti-bribery and corruption procedures on 1 July 2006.
