Enhancing the Implementation of the New Approach Directives

On 7 May 2003 the European Commission issued a Communication to the Council and the European Parliament on Enhancing the Implementation of the New Approach Directives. It addresses questions to do with Notified Bodies, Conformity Assessment, CE Marking, Market Surveillance and on the Consistent and Effective Implementation of the relevant New Approach Directives (made under what is now Article 95 of the Treaty). The Commission comes to conclusions in each of these areas on how to make them more effective.

A copy of the Communication can be downloaded from:

On 10 November 2003 the Competitiveness Council adopted a Council Resolution responding to the Commission's Communication. The adopted draft can be downloaded from:

The Commission is now working to prepare draft legislation in response to the Council Resolution of November 2003. A number of working papers have been produced and discussed with Member States but no formal proposals have been produced as yet.
