The Export Control Act 2002 was brought into force on 1st May 2004. It replaced the export control powers contained within the Import, Export and Customs Powers (Defence) Act 1939 legislation on strategic export controls and, amongst other things, provides for a more transparent framework and increased Parliamentary accountability. Click onto the Text and Explanatory Notes link in the right hand column for details of the legislation.
Orders
The Act also gives powers to extend the present controls. The Government has introduced secondary legislation, which came into force at the same time as the Act, which consolidated the previous secondary legislation and imposed a new range of controls. Guidance
These new controls are explained in detail in the guidance notes. Click on the Guidance link in the right hand column.
Review
In line with Cabinet Office Better Regulation principles, the DTI’s Export Control Organisation (“ECO”) will be launching a review of the export control legislation introduced in 2004 under the Export Control Act 2002. The review was due to be launched in May 2007, but due to logistical difficulties, the DTI has had to temporarily delay the launch. Further details can be found on the right.
