Application by Durham County Council under Part III of the Transport Act 2000: road user charging scheme in Market Place leading to Saddler Street, Durham City

1. I am directed by the Secretary of State for Transport to write to Durham County Council ("the Council") in response to the Council's letter of 20th September 2002 enclosing a road user charging scheme order made by the Council on 19th September 2002. This letter should be read in conjunction with letters of 1st August, 8th August, 29th August,13th September and 18th September about the scheme sent by the Secretary of State to the Council.

2. The Secretary of State has taken into account the matters raised in his previous letters. He has already indicated his reasons for being minded to confirm the Council's scheme order and this letter confirms his decision and incorporates the relevant reasoning of his previous letters. The Council has taken into account all the points about the earlier drafts of the order raised by the Secretary of State in his previous letters. The Council's letter of 20th September enclosed the scheme order made by the Council on 19th September 2002. In accordance with the requirements of section 169 of the Transport Act 2000, the Secretary of State confirms without modifications the County Council of Durham (Market Place leading to Saddler Street, Durham City) (Road User Charging Scheme) Order 2002.

3. A copy of this letter is being sent to other interested parties.
