Why Is An Act Needed?
Ministers can only spend public money for the purposes, and in the manner, authorised by Parliament. Where types of expenditure are made on a recurring basis it is customary for authority for these to be given in specific legislation.
What is a Statutory Instrument?
It is secondary legislation usually made by the Secretary of State under powers bestowed on her by Parliament through an Act of Parliament. It has the force of law just like an Act.
Does the Act change the way we make Statutory Instruments? Promissory Notes?
There are no material changes.
What effect does repeal of the 1980 Act have on Statutory Instruments made under it?
None. Statutory Instruments approved under the 1980 Act remain effective.
Why does the Act refer to "He"?
In legislation, the word "he" also carries the meaning of "she". It is the convention for legislation to use the masculine gender.
