Gambling Act 2005: Proposals for Gambling Commission Fees from 1 August 2009

The Department for Culture Media and Sport and the Gambling Commission are seeking views about the Gambling Commission's Fees through this consultation.
The Gambling Act 2005 (the Act) gives the Secretary of State for Culture, Media and Sport the power to make regulations setting fees to be paid to the Gambling Commission. In doing so, the Secretary of State intends to ensure such fees are set in accordance with the Act and HM Treasury's rules and guidance on fees, levies and charges set out in Managing Public Money and at a level that enables the Commission to recover the full costs of delivering its responsibilities, while avoiding cross subsidisation and ensuring fairness and value for money for the gambling industry.
In 2008, the Secretary of State undertook to review fees in the light of the Commission's experience of the first full year of compliance and enforcement work with the industry. Licensing arrangements have been in place since 1 January 2007 and the Commission has been fully operational since 1 September 2007. Although it is still in the early stages, the Commission now has more information on which to assess and review its workload, costs and fees. This consultation therefore describes in more detail the Commission's approach and cost basis as a background to the proposed fees. The consultation also seeks to reflect the current difficult economic climate and to minimise the burden of regulation on operators wherever possible.
