Guidance documents for British Films Cultural Test

The Final Framework of the Cultural Test for British Film was published by the DCMS on 5 December. The DCMS has now published draft guidelines to the new cultural test setting out how the requirement to pass the cultural test in the revised Schedule 1 to the Films Act 1985 will be operated and interpreted.
The draft Order to amend Schedule 1 and its Explanatory Memorandum have been laid before Parliament and the draft Order is subject to approval (the Order will be able to be viewed shortly via www.opsi.gov.uk).
The Regulatory Impact Assessment on the Revisions to Schedule 1 is now also available.
Full guidance for the revised Schedule 1 (to replace the current guidance published in February 2002), including the final guidelines to the new Cultural Test, will be published when the revisions to Schedule 1 come into force. This full guidance will be subject to amendment and review in light of the Finance Bill and European Commission state aid clearance. The guidance is also a living document which will be updated as the Cultural Test beds down.
The guidance for co-productions will also be updated.
