Members’ interests:

Alan Young
Alan Young, a member of the group conducting this inquiry, is currently a director of Lunar Energy Limited, a company which is developing a tidal stream renewable energy product. In 2008, Lunar Energy might bid for work with towage companies and might therefore become a customer of the merging parties.

Neither Alan Young, nor the CC believes that these matters will prejudice the ability of the Group to discharge its function in an independent and impartial manner.

Peter Stoddart
The wife of Peter Stoddart, a member of the group conducting this inquiry, holds approximately 1260 shares in Shell, and Shell is a customer of towage services.

Rob Murray
Rob Murray, a member of the Group conducting this inquiry, acts as a consultant on an ad hoc basis to Hanson Renouf, a legal practice based in Jersey. The Jersey Competition and Regulatory Authority is undertaking a study of competition and regulatory issues in the shipping and port services sector. Hanson Renouf intends to enter into discussions with a ferry operator about representing it in that investigation; if Hanson Renouf were appointed, Rob Murray would be involved. We understand that the ferry operator in question is not a customer of either of the main parties to this inquiry (Svitzer Wijsmuller A/S, and Adsteam Marine Limited); neither does it operate in ports in which the main parties also operate.

Neither Mr Murray nor the CC, believes that this matter will prejudice the ability of the Group to discharge its functions in an independent and impartial manner.

Staff interests:

Rodney Richards
Rodney Richards, a staff accountant advising the Group conducting this inquiry, owns around 12500 shares in BP and around 400 shares in Royal Dutch Shell.

The CC does not believe that the matter disclosed above affects Mr Richards’ ability to act impartially and independently in advising the Group.
